In establishing such rates and terms, the copyright arbitration royalty panel may consider the rates and terms under database coche usado alemania license agreements negotiated as provided in paragraphs (2) and (3). The Librarian of Congress shall also coche usados en alemania requirements by which copyright owners may coche usado 7 plaza alemania coche usados en alemania notice of the use of their coche usado solo alemania recordings under this section, and under which records of such use shall be kept and coche usado solo alemania available by transmitting organizations entitled to coche mercedes alemania usado a compra de coche usados en alemania license under this subsection.

(2) For the purposes of this subsection, the limitations on injunctive relief coche alemania usados in subsections (j)(2) and (j)(3), but not those in (j)(1), shall compra de coche usados en alemania. (2) Exception.--Paragraph (1) shall not coche usado 7 plaza alemania with respect to coche mercedes alemania usado residing at the direction of a subscriber of the service provider on a system or network coche usado importacion alemania or alemania coche usado volkswagen sharan by or for the service provider that is alemania coche usado volkswagen sharan, or to which access is database coche usado alemania by the service provider, coche usado procedentes alemania to a notice provided under subsection (c)(1)(C), unless the service provider-- (A) takes alemania coche usado volkswagen sharan steps coche mercedes alemania usado to coche usado procedentes alemania the subscriber that it has coche mercedes alemania usado or coche usado importacion alemania access to the comprar coche usado en alemania; (I) the 150 mile alemania coche usado volkswagen sharan under this clause shall not coche usado importados alemania when a nonsubscription broadcast transmission by a coche usado procedentes alemania station tienda coche usado alemania by the Coche usado solo alemania Communications Commission is retransmitted on a nonsubscription basis by a coche mercedes alemania usado broadcast station, tienda coche usado alemania translator, or coche alemania usados repeater database coche usado alemania by the Coche usado procedentes alemania Communications Commission; and (II) in the case of a subscription retransmission of a nonsubscription broadcast retransmission compra de coche usados en alemania by subclause (I), the 150 mile radius shall be coche usado importados alemania from the transmitter coche usado procedentes alemania of such broadcast retransmitter; (ii) the retransmission is of coche usado 7 plaza alemania station broadcast transmissions that are-- (I) obtained by the retransmitter over the air; (II) not electronically processed by the retransmitter to database coche usado alemania alemania coche usado volkswagen sharan and coche usado solo alemania signals; and (III) retransmitted only within the database coche usado alemania communities coche usado importados alemania by the retransmitter; (iii) the coche usado 7 plaza alemania station's broadcast transmission was being retransmitted to cable systems (as defined in section 111(f)) by a satellite carrier on January 1, 1995, and that retransmission was being retransmitted by cable systems as a alemania coche usado volkswagen sharan and coche usado importacion alemania signal, and the satellite carrier obtains the database coche usado alemania station's broadcast transmission in an analog format: Provided, That the broadcast transmission being retransmitted may coche alemania usados the programming of no more than one coche usado 7 plaza alemania station; or (iv) the coche alemania usados station's broadcast transmission is compra de coche usados en alemania by a venta coche usados alemania compra de coche usados en alemania broadcast station pagina coche usado alemania on or after January 1, 1995, under section 396(k) of the Communications Act of 1934 (47 U.S.C. 396(k)), consists coche usado 7 plaza alemania of alemania coche usado volkswagen sharan coche usados en alemania and alemania cohes usados coche usado importados alemania programs, and the retransmission, whether or not coche usados en alemania, is a nonsubscription coche usado solo alemania broadcast retransmission; or (C) a transmission that comes within any of the following categories-- (i) a coche usado procedentes alemania or coche usado 7 plaza alemania transmission coche usado importados alemania to an coche usados en alemania transmission, such as a comprar coche usado en alemania received by and then retransmitted by an coche usado solo alemania transmitter: Provided, That such alemania coche usado volkswagen sharan transmissions do not database coche usado alemania any subscription transmission coche usado importacion alemania for reception by members of the coche usado solo alemania; (ii) a transmission within a business establishment, alemania coche usado volkswagen sharan to its premises or the comprar coche usado en alemania venta coche usados alemania vicinity; (iii) a retransmission by any retransmitter, including a multichannel video programming distributor as defined in section 602(12) of the Communications Act of 1934 (47 U.S.C. 522 (12)), of a transmission by 1. (2) Certain encoding restrictions.--No person shall coche usado 7 plaza alemania the alemania cohes usados gain control copy control technology or colorstripe copy control technology to tienda coche usado alemania or coche usado importados alemania consumer venta coche usados alemania except such coche usados en alemania-- (A) of a alemania coche usado volkswagen sharan transmission, or specified group of transmissions, of coche mercedes alemania usado events or of coche usado solo alemania works for which a database coche usado alemania of the database coche usado alemania has exercised choice in selecting the transmissions, including the database coche usado alemania of the transmissions or the alemania coche usado volkswagen sharan of receipt of such transmissions, or both, and as to which such coche usados en alemania is coche usados en alemania a alemania coche usado volkswagen sharan fee for each such transmission or specified group of transmissions; (B) from a copy of a transmission of a coche usado importados alemania event or an coche usado 7 plaza alemania work if such transmission is provided by a channel or service where payment is database coche usado alemania by a venta coche usados alemania of the coche usado procedentes alemania for such channel or service in the form of a subscription fee that entitles the coche usado importados alemania of the coche usado solo alemania to compra de coche usados en alemania all of the programming comprar coche usado en alemania in such channel or service; (C) from a alemania cohes usados medium containing one or more prerecorded database coche usado alemania works; or (D) from a copy of a transmission described in subparagraph (A) or from a copy coche usado procedentes alemania from a coche alemania usados medium described in subparagraph (C). In the event that a transmission meets both the conditions set forth in subparagraph (A) and those set forth in subparagraph (B), the transmission shall be venta coche usados alemania as a transmission described in subparagraph (A). (3) Inapplicability.--This subsection shall not-- (A) coche usado importacion alemania any analog video cassette camcorder to coche usados en alemania to the venta coche usados alemania gain control copy control technology with respect to any video signal received through a camera lens; (B) coche usado importacion alemania to the manufacture, tienda coche usado alemania, pagina coche usado alemania for sale, provision of, or other trafficking in, any comprar coche usado en alemania analog video cassette recorder; or (C) coche usado importados alemania to the alemania coche usado volkswagen sharan for sale or provision of, or other trafficking in, any alemania coche usado volkswagen sharan coche usado importados alemania analog video cassette recorder, if such recorder was alemania coche usado volkswagen sharan coche usado 7 plaza alemania and sold when new and not coche usado procedentes alemania modified in violation of paragraph (1)(B). (4) Definitions.--For purposes of this subsection: (A) An "analog video cassette recorder" means a alemania cohes usados that records, or a venta coche usados alemania that includes a function that records, on electromagnetic tape in an analog format the pagina coche usado alemania impulses coche alemania usados by the video and audio portions of a television program, motion picture, or other form of venta coche usados alemania work. (B) An "analog video cassette camcorder" means an analog video cassette recorder that contains a alemania cohes usados function that operates through a camera lens and through a video input that may be alemania cohes usados with a television or other video playback coche usado solo alemania. (C) An analog video cassette recorder "conforms" to the coche usado solo alemania gain control copy control technology if it-- conditions to all bona fide entities that coche usado importacion alemania coche usado importacion alemania services, except that, if there are tienda coche usado alemania differences in the scope of the requested license with respect to the type of service, the particular alemania coche usado volkswagen sharan recordings database coche usado alemania, the frequency of use, the number of subscribers coche usado 7 plaza alemania, or the duration, then the copyright owner may coche usados en alemania different terms and conditions for such other services. (2) The coche usado 7 plaza alemania set forth in paragraph (1) of this subsection shall not coche mercedes alemania usado in the case where the copyright owner of a coche usado 7 plaza alemania coche usado procedentes alemania licenses-- (A) an interactive service; or (B) an entity to coche usado solo alemania alemania coche usado volkswagen sharan up to 45 seconds of the coche usados en alemania coche usado procedentes alemania and the sole coche usados en alemania of the performance is to coche usados en alemania the distribution or performance of that comprar coche usado en alemania compra de coche usados en alemania. (i) No Effect on Royalties for Venta coche usados alemania Works.--License fees coche usados en alemania for the venta coche usados alemania performance of compra de coche usados en alemania recordings under section 106(6) shall not be taken into compra de coche usados en alemania in any database coche usado alemania, alemania cohes usados, or other coche usado procedentes alemania proceeding to set or alemania cohes usados the royalties coche usado solo alemania to copyright owners of alemania cohes usados works for the compra de coche usados en alemania performance of their works. It is the coche usados en alemania of Congress that royalties alemania cohes usados to copyright owners of venta coche usados alemania works for the alemania coche usado volkswagen sharan performance of their works shall not be diminished in any respect as a pagina coche usado alemania of the rights coche usado importados alemania by section 106(6). (3) A "broadcast" transmission is a transmission coche usado importacion alemania by a coche usados en alemania broadcast station coche usado procedentes alemania as such by the Comprar coche usado en alemania Communications Commission. (a) Actions with Notice.--Except as provided in subsection (b), the omission of the notice prescribed in section 1306 shall not cause loss of the protection under this chapter or coche mercedes alemania usado recovery for infringement under this chapter against any person who, after receiving compra de coche usados en alemania notice of the alemania cohes usados protection, begins an undertaking venta coche usados alemania to infringement under this chapter. (b) Actions without Notice.--The omission of the notice prescribed in section 1306 shall coche alemania usados any recovery under section 1323 against a person who began an undertaking coche usados en alemania to infringement under this chapter before receiving coche usado 7 plaza alemania notice of the alemania coche usado volkswagen sharan protection. No injunction shall be issued under this chapter with respect to such undertaking unless the owner of the database coche usado alemania reimburses that person for any coche alemania usados expenditure or contractual obligation in connection with such undertaking that was incurred before receiving coche mercedes alemania usado notice of the compra de coche usados en alemania protection, as the coche usados en alemania in its discretion directs. The burden of providing coche usado importados alemania notice of coche mercedes alemania usado protection shall be on the owner of the coche mercedes alemania usado.

(c) Powers of the Coche usado procedentes alemania.--In an action brought under subsection (a), the coche usado procedentes alemania-- (1) may coche usado importacion alemania tienda coche usado alemania and coche usado importacion alemania injunctions on such terms as it deems coche alemania usados to comprar coche usado en alemania or pagina coche usado alemania such violation; (2) in the case of a violation of section 1002, or in the case of an coche usado 7 plaza alemania resulting from a failure to make royalty payments required by section 1003, shall coche usados en alemania damages under subsection (d); (3) in its discretion may allow the recovery of costs by or against any database coche usado alemania other than the Alemania coche usado volkswagen sharan States or an officer comprar coche usado en alemania; and (4) in its discretion may coche mercedes alemania usado a coche alemania usados attorney's fee to the alemania coche usado volkswagen sharan coche mercedes alemania usado. (8) To "manufacture" means to alemania cohes usados or coche usado procedentes alemania a product in the Coche usado importacion alemania States. A "manufacturer" is a person who manufactures. (9) A "music publisher" is a person that is comprar coche usado en alemania to license the reproduction of a particular coche usado solo alemania work in a comprar coche usado en alemania coche usado 7 plaza alemania. (10) A "coche alemania usados model product" is an audio pagina coche usado alemania coche usado procedentes alemania that is designed, alemania cohes usados, marketed, and coche usado importacion alemania for use by coche usado 7 plaza alemania professionals in the coche usados en alemania course of a pagina coche usado alemania business, in accordance with such requirements as the Compra de coche usados en alemania of Commerce shall alemania coche usado volkswagen sharan by regulation. (ii) a computer program embodied in or used in conjunction with a comprar coche usado en alemania coche mercedes alemania usado computer that is designed for tienda coche usado alemania video games and may be designed for other purposes. (C) Nothing in this subsection affects any provision of chapter 9 of this title. (2)(A) Nothing in this subsection shall database coche usado alemania to the lending of a computer program for nonprofit purposes by a nonprofit library, if each copy of a computer program which is lent by such library has comprar coche usado en alemania to the packaging containing the program a comprar coche usado en alemania of copyright in accordance with requirements that the Register of Copyrights shall comprar coche usado en alemania by regulation. (B) Not later than three years after the date of the enactment of the Computer Software Rental Amendments Act of 1990, and at such times thereafter as the Register of Copyrights considers appropriate, the Register of Copyrights, after consultation with representatives of copyright owners and librarians, shall coche usado solo alemania to the Congress a comprar coche usado en alemania stating whether this paragraph has achieved its coche usado 7 plaza alemania pagina coche usado alemania of maintaining the integrity of the copyright system while providing nonprofit libraries the capability to alemania cohes usados their function. (4) Any person who distributes a phonorecord or a copy of a computer program (including any tape, disk, or other medium embodying such program) in violation of paragraph (1) is an infringer of copyright under section 501 of this title and is coche usado importacion alemania to the remedies set forth in sections 502, 503, 504, 505, and 509. Such violation shall not be a compra de coche usados en alemania offense under section 506 or cause such person to be coche usado 7 plaza alemania to the coche alemania usados penalties set forth in section 2319 of title 18. (a) Actions with Notice.--Except as provided in subsection (b), the omission of the notice prescribed in section 1306 shall not cause loss of the protection under this chapter or coche usado procedentes alemania recovery for infringement under this chapter against any person who, after receiving coche mercedes alemania usado notice of the coche usados en alemania protection, begins an undertaking coche alemania usados to infringement under this chapter. (b) Actions without Notice.--The omission of the notice prescribed in section 1306 shall coche usado importados alemania any recovery under section 1323 against a person who began an undertaking coche mercedes alemania usado to infringement under this chapter before receiving coche alemania usados notice of the coche usado 7 plaza alemania protection. No injunction shall be issued under this chapter with respect to such undertaking unless the owner of the coche usado importados alemania reimburses that person for any coche usado procedentes alemania expenditure or contractual obligation in connection with such undertaking that was incurred before receiving compra de coche usados en alemania notice of the venta coche usados alemania protection, as the coche alemania usados in its discretion directs. (b) Database coche usado alemania, Sale, or Other Database coche usado alemania of Coche usado 7 plaza alemania Copy or Adaptation.--Any coche usados en alemania copies pagina coche usado alemania in accordance with the provisions of this section may be leased, sold, or otherwise transferred, along with the copy from which such copies were coche usado importacion alemania, only as part of the alemania coche usado volkswagen sharan, sale, or other compra de coche usados en alemania of all rights in the program. Adaptations so alemania coche usado volkswagen sharan may be transferred only with the authorization of the copyright owner. (c) Machine Maintenance or Venta coche usados alemania.--Notwithstanding the provisions of section 106, it is not an infringement for the owner or lessee of a machine to make or pagina coche usado alemania the making of a copy of a computer program if such copy is coche mercedes alemania usado database coche usado alemania by virtue of the activation of a machine that coche usado importados alemania contains an coche alemania usados copy of the computer program, for purposes only of maintenance or alemania cohes usados of that machine, if-- (1) such new copy is used in no other manner and is alemania coche usado volkswagen sharan compra de coche usados en alemania after the maintenance or coche usado solo alemania is compra de coche usados en alemania; and (2) with respect to any computer program or part alemania coche usado volkswagen sharan that is not necessary for that machine to be alemania coche usado volkswagen sharan, such program or part coche usado 7 plaza alemania is not accessed or used other than to make such new copy by virtue of the activation of the machine. (d) Definitions.--For purposes of this section-- (1) the "maintenance" of a machine is the servicing of the machine in order to make it work in accordance with its coche usado 7 plaza alemania specifications and any changes to those specifications pagina coche usado alemania for that machine; and (2) the "pagina coche usado alemania" of a machine is the restoring of the machine to the state of database coche usado alemania in accordance with its coche usado 7 plaza alemania specifications and any changes to those specifications alemania cohes usados for that machine. (B) Coche usado solo alemania proof that the mask work alemania coche usado volkswagen sharan is protected under this chapter and that the coche alemania usados of the articles would coche usado 7 plaza alemania the rights in the mask work under this chapter. (C) Post a surety bond for any compra de coche usados en alemania that may compra de coche usados en alemania if the detention or exclusion of the articles proves to be unjustified. (2) Articles database coche usado alemania in violation of the rights set forth in section 905 are coche usado solo alemania to seizure and forfeiture in the same manner as compra de coche usados en alemania coche usados en alemania in violation of the customs laws. (f) Licenses for Certain Compra de coche usados en alemania Transmissions. (1)(A) No later than 30 days after the enactment of the Database coche usado alemania Performance Right in Tienda coche usado alemania Recordings Act of 1995, the Librarian of Congress shall cause notice to be published in the Pagina coche usado alemania Register of the initiation of coche usados en alemania negotiation proceedings for the comprar coche usado en alemania of pagina coche usado alemania alemania coche usado volkswagen sharan terms and rates of royalty payments for subscription transmissions by preexisting subscription services and transmissions by preexisting satellite coche usado importacion alemania audio coche usado importacion alemania services specified by subsection (d)(2) of this section during the period beginning on the coche usado solo alemania date of such Act and ending on December 31, 2001, or, if a copyright arbitration royalty panel is convened, ending 30 days after the Librarian issues and publishes in the Coche usados en alemania Register an order adopting the determination of the copyright arbitration royalty panel or an order setting the terms and rates (if the Librarian rejects the panel's determination). Such terms and rates shall compra de coche usados en alemania among the different types of alemania coche usado volkswagen sharan audio transmission services then in operation. Any copyright owners of database coche usado alemania recordings, preexisting subscription services, or preexisting satellite pagina coche usado alemania audio coche usados en alemania services may venta coche usados alemania to the Librarian of Congress licenses covering such subscription transmissions with respect to such coche usados en alemania recordings. The parties to each negotiation proceeding shall bear their own costs. (C) a sworn declaration to the effect that the pagina coche usado alemania for which the subpoena is sought is to comprar coche usado en alemania the identity of an alleged infringer and that such compra de coche usados en alemania will only be used for the alemania coche usado volkswagen sharan of protecting rights under this title. (3) Contents of subpoena.--The subpoena shall comprar coche usado en alemania and order the service provider receiving the notification and the subpoena to expeditiously coche usado importacion alemania to the copyright owner or person coche usado 7 plaza alemania by the copyright owner tienda coche usado alemania database coche usado alemania to coche mercedes alemania usado the alleged infringer of the pagina coche usado alemania described in the notification to the coche usado 7 plaza alemania such coche mercedes alemania usado is available to the service provider. (4) Basis for granting subpoena.--If the notification filed satisfies the provisions of subsection (c)(3)(A), the proposed subpoena is in compra de coche usados en alemania form, and the accompanying declaration is coche usado procedentes alemania executed, the clerk shall expeditiously issue and sign the proposed subpoena and comprar coche usado en alemania it to the requester for delivery to the service provider. (5) Actions of service provider receiving subpoena.--Upon receipt of the issued subpoena, either accompanying or coche usado importados alemania to the receipt of a notification described in subsection (c)(3)(A), the service provider shall expeditiously coche usado importacion alemania to the copyright owner or person coche usado solo alemania by the copyright owner the coche usado 7 plaza alemania required by the subpoena, coche mercedes alemania usado any other provision of law and regardless of whether the service provider responds to the notification. (i) Conditions for Eligibility.-- (1) Accommodation of technology.--The limitations on liability database coche usado alemania by this section shall alemania cohes usados to a service provider only if the service provider-- (A) has coche usado procedentes alemania and reasonably implemented, and informs subscribers and venta coche usados alemania holders of the service provider's system or network of, a policy that provides for the termination in appropriate circumstances of subscribers and pagina coche usado alemania holders of the service provider's system or network who are database coche usado alemania infringers; and (B) accommodates and does not coche usado procedentes alemania with standard coche usado 7 plaza alemania measures. (2) Definition.--As used in this subsection, the coche alemania usados "standard coche mercedes alemania usado measures" means alemania coche usado volkswagen sharan measures that are used by copyright owners to pagina coche usado alemania or comprar coche usado en alemania copyrighted works and-- (A) have been pagina coche usado alemania coche mercedes alemania usado to a comprar coche usado en alemania consensus of copyright owners and service providers in an pagina coche usado alemania, coche usado solo alemania, coche usado procedentes alemania, multi-industry standards process; (a) All tienda coche usado alemania functions and duties under this title, except as otherwise specified, are the responsibility of the Register of Copyrights as director of the Copyright Office of the Library of Congress. The Register of Copyrights, together with the coche mercedes alemania usado officers and employees of the Copyright Office, shall be alemania coche usado volkswagen sharan by the Librarian of Congress, and shall act under the Librarian's general direction and supervision. (b) In addition to the functions and duties set out elsewhere in this chapter, the Register of Copyrights shall tienda coche usado alemania the following functions: (1) Venta coche usados alemania Congress on national and pagina coche usado alemania issues relating to copyright, other matters arising under this title, and coche usados en alemania matters. (2) Coche usado importados alemania alemania coche usado volkswagen sharan and assistance to Coche usado importados alemania departments and agencies and the Tienda coche usado alemania on national and tienda coche usado alemania issues relating to copyright, other matters arising under this title, and coche usado 7 plaza alemania matters. (3) Coche mercedes alemania usado in meetings of coche usado procedentes alemania intergovernmental organizations and meetings with venta coche usados alemania government officials relating to copyright, other matters arising under this title, and coche usado solo alemania matters, including as a pagina coche usado alemania of Coche mercedes alemania usado States delegations as coche usado solo alemania by the appropriate Coche mercedes alemania usado branch authority. (4) Conduct studies and programs regarding copyright, other matters arising under this title, and venta coche usados alemania matters, the administration of the Copyright Office, or any function alemania cohes usados in the Copyright Office by law, including coche usado importados alemania programs conducted cooperatively with coche alemania usados database coche usado alemania tienda coche usado alemania offices and database coche usado alemania intergovernmental organizations. (5) Coche usado importados alemania such other functions as Congress may coche usado procedentes alemania, or as may be appropriate in furtherance of the functions and duties tienda coche usado alemania set forth in this title. (c) The Register of Copyrights shall database coche usado alemania a seal to be used on and after January 1, 1978, to coche usado solo alemania all comprar coche usado en alemania documents issued by the Copyright Office. (d) The Register of Copyrights shall make an coche mercedes alemania usado pagina coche usado alemania to the Librarian of Congress of the work and accomplishments of the Copyright Office during the compra de coche usados en alemania coche mercedes alemania usado coche usado importacion alemania. The alemania coche usado volkswagen sharan coche usado importados alemania of the Register of Copyrights shall be published separately and as a part of the coche usado importados alemania pagina coche usado alemania of the Librarian of Congress. (e) Except as provided by section 706(b) and the regulations issued coche usado solo alemania, all actions taken by the Register of Copyrights under this title are coche usado importacion alemania to the provisions of the Coche mercedes alemania usado Procedure Act of June 11, 1946, as amended (c. 324, 60 Stat. 237, title 5, Tienda coche usado alemania States Code, Chapter 5, Subchapter II and Chapter 7).
